Carefully Dealing with Marital Property Division and Debt
Division of both property and debt in divorce is governed by a legal principle called "equitable division." Because property owned by married couples in California is considered, community property, that usually means that property owned and debt acquired by either spouse is divided equally.
There are, however, exceptions to the basic community property rule. For instance, if one spouse owned a home before the marriage and the other spouse was brought in as an owner during the marriage, the division can be more complicated than usual. There are also times when it is difficult to assign a value to marital property.
I strongly encourage my clients to settle out of court, unless the only way to settle is to give in to the other spouse's unreasonable demands. In those cases, I have the experience to vigorously represent my clients' interests in court.
