My Role as Your MediatorMediation is different from the other legal services I provide, in that I am not the attorney for either spouse and do not advise them on their legal rights. I am a neutral participant in the process. So if you are considering mediation, I would advise you to consult with another attorney before signing the mediation contract and the divorce settlement. Divorce mediation is an alternative to having your divorce issues resolved in court. I have been trained in mediation since 1988 and can help couples reach a divorce settlement that works for both of them. If you need an experienced mediator for your divorce, contact me. I'm happy to provide a free 30-minute consultation for people who are considering hiring a mediator.
Mediation has significant benefits. It is less expensive than either a divorce trial or settlement negotiations in which each side is represented by a lawyer. It also allows you to negotiate a settlement that meets your individual needs.
Instead of an adversarial divorce process that can often aggravate conflict and interfere with the long-term relationships between parents and children, mediation allows you to find solutions that work for both spouses.
The process also includes a confidentiality agreement that allows you to honestly share information without the possibility of it being used against you in court.
Mediation works for most people but not for everyone. Both spouses need to be motivated by a desire to reach an agreement, not anger.
The divorce mediation process I use includes several initial agreements. If you have children, both spouses must agree to protect the children's best interests when resolving child custody and other issues. Both spouses must also agree to tell the truth. If I believe either spouse is violating either of these agreements, I can and will end the mediation.
After an agreement is reached, you will have at least three days to consider it before it is signed.
When you are looking for a trained mediator with the legal knowledge of an experienced family law attorney, contact me.
